The 5 lawsuits against Green Mountain orchestrated by Big Sky to force Green Mountain to go along with creating Big Sky as the new “master meter” sanitation district for Rooney Valley are beginning to address some of the issues.

Keep in mind Big Sky and the other developers have several ways to obtain sewer service other than an election night agreement signed by the old board as they were being voted out of office.

Problem is, they all involve public applications, public hearings and a public vote.  Those pesky things which this particular developer community tries to avoid.

The developers are taking mixed positions on consolidating the cases.  Some outright opposed consolidating the cases.  Others want to consolidate them to save costs but keep them separate for trial.  The theme appears to be whatever will cost Green Mountain the most.

Green Mountain has filed motions to dismiss certain counts.  Big Sky has moved for summary judgment as to some counts.  Each side has an opportunity to respond to each of these briefs so there will be more to come.

Here are the issues briefs files so far:

Filed by Green Mountain:

Green Mountain Motion Sum Jud 9-11

Green Mountain Mtn Dis 3 Dinos

Green Mountain Mtn Dis Cardel

Green Mountain Mtn Dis CDN

Green Mountain Mtn Dis Stream

Filed by Big Sky:

Big Sky Motion Sum Jud 1

And this group of developers (Cardel, Stream Realty, Three Dinos) wants Green Mountain and the public to work with them to develop Rooney Valley.   Talk about burning bridges.

And Adam Paul is one of their cheerleaders.  He fully supports Big Sky as the new profit making sanitation district for Rooney Valley without any public accountability.

Indeed, Adam Paul recently expressed pride in orchestrating the Solterra IGA with Green Mountain – that expires in 2023 and leaves Solterra residents with no right to vote on Green Mountain board members or issues – and if the pipes break or need replacing Solterra pays the bill.  What a great idea.  So glad he supported that developer sponsored approach to managing future residents’ liability and financing.

  1. 1. Hope Solterrans are lining up their new sewage collection and treatment service provider. GMWSD and its beleaguered citizens having to pay for all these wasteful legal fees will not be renewing a VOLUNTARY contract with solterrans who CONTINUE TO ALLOW the people responsible for the Solterra development to maliciously sue Solterra neighbors in an attempt to intimidate us into allowing illegal (skip the established public process) bullying.
    2. This wont stop until the Mayor of Lakewood, Adam Paul, who was part of Creating, and still allows in this flagrant ignoring of the municipal process for special districts, is voted out in November.

  2. Wait a minute. Am I reading this correctly? Three Dinos, et al want us to work with them to develop Rooney Valley? There was an easier way to get that done. Like say “ok” when we asked THREE TIMES or more, for that 4 years ago. I’d have to that ship has fairly sailed.
