Big Sky first tried to get the Solterra Board of Directors to sue Green Mountain Water and Sanitation District over the terminated Big Sky IGA (Intergovernmental Agreement).
The Solterra Board, unknown to the Solterra residents, initially went along with Big Sky and threatened to sue Green Mountain. When the Soltera residents objected, the Solterra Board backed down.
So Big Sky sued Green Mountain directly on June 2, 2019.
Big Sky’s lawsuit seeks to force Green Mountain back into the Big Sky IGA. Predictably it makes many false claims which will be addressed by Green Mountain in their answer which is due July 23.
Once the answer is filed, I will post both the complaint and answer.
The parties in cases such as this will likely exchange discovery which could include depositions of key players including Mr. Tom Morton and Mayor Paul.
Trial in a case like this should occur sometime within the next 12 months.
Big Sky also published their intent to enforce the IGA in a legal advertisement two days after Green Mountain terminated the Big Sky IGA. Big Sky failed to disclose to the public or the Court that the Big Sky IGA had already been terminated. If no one objected, Big Sky was planning to go forward with the Big Sky IGA, completely ignoring the fact that it no longer existed.
So, in a separate action, in front of the same judge handling the new Big Sky lawsuit, Green Mountain objected to Big Sky trying to enforce, by publication, the IGA which had just been terminated. Green Mountain also asked the Court to simply combine this issue with the new case.
Big Sky is simply trying to get in through the back door what they were already trying to achieve with the lawsuit through the front door.
More to come. It is expected that this case will determine once and for all whether the citizens or Big Sky (Tom Morton) will decide how sewer is going to be managed for any potential future development in the Rooney Valley.
